On Friday, police shot and killed a 39-year-old man in Weslaco after he told a negotiator that he could see officers and was going to kill them. The Hidalgo County Sheriff’s Office sent a custodial death report about the death of Rigo Mendez to the Texas Attorney General’s Office on Tuesday. The report gives more details about the shooting that led to two deputies and two Texas Department of Public Safety troopers being put on administrative leave, as is standard for both agencies.
According to the custodial death report, deputies and troopers went to Mendez’s home at 7112 Mile 3 1/2 Road at about 3:24 p.m. after a concerned citizen called dispatch to say that someone at the house was shooting while children were there. After the shooting, Hidalgo County Sheriff J.E. “Eddie” Guerra said on Twitter that neighbors had called the police to say they heard shots inside the house and were worried about the children inside.
The custodial death report said that when they got there, Mendez was inside the house with a gun. The report said, “The deputies then heard gunshots coming from inside the house.” “The deputies hid because they could see that shots were being fired at them.” The DPS troopers then arrived, and a negotiator talked to Mendez. “He said he could see police officers and was going to kill them,” the negotiator said. The report said that Mendez left the house with a gun through the garage.
The report said, “At that point, shots were fired back and forth, and the suspect fell to the ground.” In that document, it said that deputies gave Mendez first aid right away and that he was flown to a hospital in Edinburg, where he died. According to the report, he died at 5:17 p.m. If Mendez had lived, he would have been charged with two counts of trying to kill someone with the death penalty, and the report said he also did crimes against children.
The Texas Rangers and a sheriff’s office team that looks into police shootings are still looking into what happened.
