A man who lives in the 2600 block of North Augusta Drive contacted 911 to tell that someone had just shot at him outside of his residence. The man’s age was given as 28.
Based on the findings of the preliminary investigation, it appears that the victim was at his residence with his ex-girlfriend. Angel J. Gutierrez-Cervantes, 25, from the 1700 block of Jethro Avenue in Zion, arrived at the residence to pick up the victim’s ex-girlfriend. He was arrested for the homicide. The ex-girlfriend of the victim left the house and got into Gutierrez-Cervantes’ vehicle after leaving the residence. The victim went outside and tried to persuade his ex-girlfriend, who was with Gutierrez-Cervantes, not to leave with him because of his former partner’s degree of intoxication.
The anger that Gutierrez-Cervantes felt led him to draw his gun and get out of his automobile. He moved in close to the victim and fired a shot in an attempt to kill the victim, but the shot missed its target. After returning to his vehicle, Gutierrez-Cervantes took off running. A short distance from the victim’s home, he let off the victim’s ex-girlfriend from their relationship.
The victim dialed 911 and pursued Gutierrez-Cervantes after the suspect fled. In Waukegan, the vehicle belonging to Gutierrez-Cervantes was discovered by deputies of the sheriff’s office in the vicinity of Alta Vista Drive and Beech Avenue. Following a traffic stop, officials from the sheriff’s office were able to take Gutierrez-Cervantes to jail. A 9mm pistol was found inside Gutierrez-Cervantes’ vehicle after it was searched. At the location of the incident, evidence techs from the sheriff’s office found a shell casing for a 9mm pistol.
The Lake County State’s Attorney’s Office, after analyzing the incident’s facts and circumstances, approved the charges of Aggravated Discharge of a Firearm, which is a Class 1 Felony.
A Class 4 Felony is being charged for the Aggravated Unlawful Use of a Weapon without a CCL. The initial court hearing for Gutierrez-Cervantes is scheduled to take place this morning, therefore he is still being held in the Lake County Jail. Until their guilt is established in a legal proceeding, the presumption of innocence applies to all defendants.
